Terms of Service

These Terms of Service (“Terms”) govern your use of SexPoints™, a private relationship game for couples, together with any related websites, features and services (collectively, the “Service”). By creating an account or using the Service you agree to these Terms.

SexPoints is operated by SexPoints (“we”, “us”, “our”). If you do not agree with these Terms, please do not use the Service.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. SexPoints is intended for consenting adult couples. Each partner creates their own account, and two accounts link together to form a “couple”.

You are responsible for keeping your login credentials secure and for all activity under your account.

SexPoints is built on consent. Points, challenges, the wheel and rewards are playful tools for appreciation between partners — they never buy, require or entitle anyone to intimacy of any kind. Every partner can decline an invitation, challenge or reward at any time, and the Service is designed so that declining carries no penalty.

You and your partner are solely responsible for what you agree to include in your private game. We do not monitor the contents of couples' private activity.

Your game data — points, check-ins, challenges, rewards, journal entries and similar — belongs to you and your partner as described in our Privacy Policy. Private journal entries are visible only to their author.

You may delete your account at any time, which removes your personal data from the Service as described in the Privacy Policy.

You agree not to: use the Service to harass, coerce or exploit anyone; impersonate another person; attempt to access another couple's private data; scrape, reverse-engineer or interfere with the Service; or use the Service for any unlawful purpose.

Vendor accounts must provide accurate business information. We may review, reject, suspend or remove any vendor or listing at our discretion, and all vendor content must comply with applicable law and our marketplace guidelines.

The vendor marketplace lets approved businesses publish listings, offers and sponsored content to couples. We do not own or operate vendors, and we are not a party to any transaction or booking you make with them. Any purchase, visit or experience you arrange with a vendor is solely between you and that vendor.

Listings and sponsored offers are provided by vendors and are clearly labelled. We do not guarantee the quality, safety or legality of vendor offerings.

If a paid plan is offered, its price, features and renewal terms will be presented to you before purchase. Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time; cancellation takes effect at the end of the current billing period.

Where local consumer law gives you a right of withdrawal or refund, we honour it.

The Service, including its name, branding, design and code, is owned by us and protected by intellectual property law. You may not copy, modify or redistribute any part of the Service without our written permission. Your own content remains yours.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of the Service, and our total liability to you will not exceed the amount you paid us in the 12 months before the claim (or, if you paid nothing, $50). Nothing in these Terms limits liability that cannot lawfully be limited.

We may update these Terms from time to time. When we make material changes we will notify you in the Service, and continued use after that notice means you accept the updated Terms.

We may suspend or terminate accounts that violate these Terms. You may stop using the Service and delete your account at any time.
